Green Valley Manufacturing, Inc. warrants to the original purchaser of this equipment that it is of proper material and first-class workmanship. As the sole and exclusive remedy in the discharge of this warranty, Green Valley Manufacturing, Inc. (hereafter referred to as GVMI) agrees to repair or replace FOB Mt. Zion, Illinois, any equipment or parts of its own manufacture which prove to be defective in material or workmanship, within 1 (one) year or 2000 operating hours, whichever comes first, from the date of shipment to the original purchaser, provided such purchaser gives prompt written notice of such alleged defects, and if requested by GVMI, returns the defective equipment or component to the factory, freight prepaid for inspection and resolution.
In the case of equipment or parts not manufactured by GVMI, its liability is limited to such adjustment as the manufacturer thereof makes to GVMI. Green Valley Manufacturing, Inc. undertakes no responsibility for work performed or expense incurred in connection with the repair or replacement, except on specific, written authority from GVMI. It is agreed that neither GVMI nor its representatives from which the equipment may be purchased, shall have any liability for general, special or consequential damages or for negligence, and that there is no warranty of fitness for a particular purpose.
The manufacturer reserves the right to make changes in design and changes or improvements upon its products without any obligations upon itself to install the same upon its products therefore manufactured.
Green Valley Manufacturing, Inc. does specifically warrant that its standard products, special and custom equipment shall perform to meet GVMI’s stated specifications providing all equipment is maintained according to manufacturer’s specifications and is operated only by properly trained personnel. Also the operating environment for GVMI’s equipment must be of satisfactory quality. For mobile vehicles, the floors must be of satisfactory quality, relative to slope, smoothness, flatness, undulations, cracks, and surface finish.
